What to Do If You Are Arrested

Your criminal defense case begins the moment you encounter the police. You do not have to answer their questions or even identify yourself unless the police detain you. You can ask the police at any time if you are free to go, and if they say no, you are being detained.

If you are detained, you must identify yourself, but you are not obliged to answer other questions—and you should not. Instead, tell the police you choose to remain silent and ask for a lawyer.

If You Are Stopped in a Vehicle

When you are stopped while driving, you must present your license, registration, and insurance information on request. You do not need to consent to a search.
If the officers suspect you are driving under the influence of alcohol or drugs, they may arrest you on suspicion of DUI. Once arrested, you may be asked to provide a urine or blood sample for testing. Under O.C.G.A. § 40-5-55, a refusal to consent to testing can be used to suspend your driver’s license for one year. Additionally, your refusal may be used against you in a DUI prosecution.
