What to Do If You Are Arrested
Your criminal defense case begins the moment you encounter the police. You do not have to answer their questions or even identify yourself unless the police detain you. You can ask the police at any time if you are free to go, and if they say no, you are being detained.
If you are detained, you must identify yourself, but you are not obliged to answer other questions—and you should not. Instead, tell the police you choose to remain silent and ask for a lawyer.

If You Are Stopped in a Vehicle

Once arrested, you may be asked to provide a urine or blood sample for testing. Under O.C.G.A. § 40-5-55, a refusal to consent to testing can be used to suspend your driver’s license for one year.
